Part I: Terms of Service
These Terms of Service (“Terms”) constitute a legally binding agreement between you (“Client,” “User,” or “you”) and AP Business Collective LLC, with SAMEOLDNEW as a DBA / brand of AP Business Collective LLC (the “Company,” “we,” “us,” or “our”). By accessing our website (apbusinesscollective.com), participating in our coaching programs, attending our keynotes or retreats, or utilizing our proprietary leadership development methodologies, you agree to be bound by these Terms.
1. Our Services
AP Business Collective LLC is a human-centered leadership development firm. We provide:
- Keynotes & Workshops: Strategy, storytelling, and mindset transformation sessions.
- Executive & Group Coaching: Personalized 1:1 support and cohort-based leadership development.
- Team Building & Retreats: Sessions focused on trust, collaboration, and performance utilizing the proprietary AP Methodology.
- Digital Content: Assessments, frameworks, and educational materials.
2. Not Professional Advice
Our services are educational and developmental in nature. You acknowledge and agree to the following:
- Coaching is not Therapy: Coaching is not a substitute for licensed counseling, psychotherapy, or mental health care.
- No Professional Guarantees: Nothing provided by the Company constitutes legal, financial, accounting, or medical advice.
- Individual Responsibility: While we co-create growth journeys, measurable behavior change and outcomes depend on your own participation, implementation, and external factors beyond our control.
3. Registrations and Payments
- Fees: Prices for services are stated at the time of purchase or within a specific Statement of Work.
- Payment Processing: We use third-party processors. You agree to their terms and represent that you have the legal right to use the payment method provided.
- Refund & Cancellation Policy: Refunds for programs and services are handled on a case-by-case basis unless otherwise stated at checkout. For coaching engagements, cancellations made with at least 24 hours' notice before a scheduled session are eligible for a full refund of that session or rescheduling at no cost. Cancellations made less than 24 hours before a session are subject to a partial charge as described in the Coaching Session Reschedule & No-Show Policy. For events and challenges, cancellations allow you to transfer your registration to the next available program run. No refunds are issued for no-shows to events or challenges. Specific refund terms for each program will be stated at the point of purchase.
- Coaching Session Reschedule & No-Show Policy: We understand life happens. If you need to reschedule a coaching session, please notify us at least 24 hours in advance and we will happily accommodate you at no charge. Cancellations made less than 24 hours before a scheduled session will result in a partial charge of 50% of the session fee. If you miss a session without any advance notice (no-show), you may be charged the full session fee at our discretion, or offered a one-time reschedule as a courtesy. For challenges and events, cancellations allow you to reschedule for the next time we run that program. This policy is designed to be fair to those who are serious about their growth while deterring abuse of our time and availability.
4. Intellectual Property
All materials, including but not limited to the AP Methodology, workbooks, frameworks, session recordings, and branding (SAMEOLDNEW), are the exclusive property of AP Business Collective LLC. You are granted a limited, non-transferable license for personal or internal organizational use only. You may not record sessions, redistribute, or resell any content without express written permission.
5. Limitation of Liability
To the maximum extent permitted by law, AP Business Collective LLC shall not be liable for any indirect, incidental, special, or consequential damages. Our total liability for any claim arising out of these Terms or our services is limited to the total amount paid by you to the Company in the twelve (12) months preceding the event giving rise to the claim.
6. Force Majeure
Neither party shall be liable for any delay or failure to perform its obligations under these terms if such delay or failure is caused by events beyond the party's reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, civil unrest, public health emergencies, pandemics, government actions, strikes, or failures of internet infrastructure. This section does not excuse payment obligations.
7. Severability
If any provision of these terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect, and the invalid provision shall be modified to the minimum extent necessary to make it enforceable while preserving the parties' intentions.
8. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles.
Part II: Privacy Policy
1. Information We Collect
- Contact Information: Name, email, phone number, and organization.
- Engagement Data: Assessment responses, quiz results, and communications sent to us.
- Transaction Data: Purchase history and billing information (processed securely via third parties).
- Automated Data: IP addresses, browser types, and usage patterns collected via cookies through our CRM and funnel platforms (e.g., HighLevel/LeadConnector).
2. How We Use Your Information
We use your data to deliver services, process payments, provide assessment results, and send marketing communications. You may opt out of marketing at any time.
3. Text Messaging (SMS)
By opting into our SMS services, you agree to receive event reminders and notifications.
- Message and data rates may apply.
- Opt-Out: Reply "STOP" to cancel at any time.
- Privacy: No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Opt-in data and consent for SMS are not sold or shared.
4. Data Sharing & Security
We do not sell your personal information. We share data only with essential service providers (e.g., CRM, payment processors, video conferencing) who are contractually obligated to protect your data. While we implement reasonable technical safeguards, no internet transmission is 100% secure.
5. Your Rights
You may request access to, correction of, or deletion of your personal data by contacting us at the email address below. California residents may have additional rights regarding data portability and "Do Not Sell" requests.
